Introduction

This website (the “Site”) offers information, products, and services related to real estate (the “Services”) that Smithsonian Real Estate provides. We operate this website and may use third-party contractors to support the delivery of the Services and the Site (“Service Providers”).

If you are a visitor to this Site, this Privacy Policy and Terms of Use applies to you and describes the policies and practices regarding the collection, use, and disclosure of your personal information in connection with your use of the Site. We act as the controller of your personal data, and our Service Providers assist us in providing the Services solely in their capacities as service providers and data processors.

1. Personal Information We Collect

We collect information from you in various ways when you access or use the Site or otherwise interact with the Services. This may include contact information you provide (such as your name, email address, home address, and phone number), feedback or correspondence, and marketing preferences and consents.

We may also obtain information from third parties, including social media platforms, data enrichment sources, property records, and analytics services. If you communicate with us via email or text, or through our CRM tools, we may collect and process message content, metadata, timestamps, and communication history.

We and our Service Providers may automatically log device data (operating system, browser type, IP address, general location) and online activity data using cookies, local storage technologies, and web beacons.

2. How We Use Your Personal Information

We use your personal information to provide and operate our Services and Site, manage our relationship with you, send follow-up and (where you have opted in) marketing communications, comply with law, prevent fraud, and create anonymized data for analysis and business purposes.

3. Use of Artificial Intelligence

We use artificial intelligence and machine learning technologies to generate or enhance content (such as property descriptions and marketing materials), assist with communications, and provide analysis and recommendations. While we review AI-generated content, it may contain errors, and you should not rely solely on it for important decisions without independent verification.

You have the right to request information about AI use, request human review of significant AI-assisted decisions, opt out of certain AI features where feasible, and provide feedback. To exercise these rights, contact us using the information below.

4. How We Share Your Personal Information

We do not “sell” personal information. We may share it with our internal team, partners, and affiliates; our Service Providers; professional advisors; for compliance, fraud prevention, and safety; and in connection with a business transfer. We will never disclose phone numbers and SMS consent with any third parties for marketing purposes.

5. Advertising and Tracking Technologies

We may share certain information with third-party advertising platforms (including Meta and Google) to deliver targeted advertisements, measure campaign effectiveness, build lookalike audiences, and track conversions. We use tracking pixels and similar technologies and participate in interest-based advertising.

6. Privacy Choices and Opt-Outs

You can opt out of online tracking by blocking cookies, limiting your mobile advertising ID, or using privacy plug-ins. Advertising partners such as Google and Facebook offer their own opt-out tools, as do the Digital Advertising Alliance and Network Advertising Initiative.

To opt out of SMS communications, reply STOP to any message. To unsubscribe from emails, follow the unsubscribe link in the email. Depending on your location, you may also have rights to access, correct, or delete your personal information.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including legal, accounting, and reporting requirements. When information is no longer necessary, we securely delete or anonymize it.

8. Third Party Services

The Site may contain links to websites and online services operated by third parties. These links are not an endorsement, and we are not responsible for the actions of third parties.

9. Security

We employ technical, organizational, and physical safeguards designed to protect personal information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Children

Our Services are not intended for use by children under 18 years of age. If we learn we have collected personal information from a child under 18 without the required consent, we will delete it.

11. SMS Text Messaging Terms of Use

We use SMS text messaging to confirm appointments, send reminders, and notify clients of schedule updates. You can cancel at any time by texting STOP, and reply HELP for assistance. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply and message frequency may vary.

12. How to Contact Us

13. Changes to this Privacy Policy and Terms of Use

We reserve the right to modify this Privacy Policy and Terms of Use at any time. If we make material changes, we will notify you by updating the date and posting it on this website.

14. California Residents

If you are a California resident, the CCPA (as amended by the CPRA) provides additional rights, including requests to know the categories and specific pieces of personal information we collect, requests to delete or correct, and the use of authorized agents. Submit requests via email at laurawolfenbarger@gmail.com or the mailing address above.
